IN NO EVENT SHALL NETVIPER'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID NETVIPER IN THE LAST SIX MONTHS, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless NetViper and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your violation of any term of these Terms of Service
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your content caused damage to a third party

11. Data Collection and Privacy

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Athens, Greece, and you hereby consent to personal jurisdiction and venue therein.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the website shall first be resolved through good faith negotiations. If the dispute cannot be resolved through negotiations within thirty (30) days, either party may pursue legal remedies in accordance with Section 12.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and NetViper regarding the use of the website and supersede all prior agreements and understandings.

16. Waiver

The failure of NetViper to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by NetViper.

17. Changes to Terms

NetViper reserves the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website after any revisions become effective, you agree to be bound by the revised terms.

18. Termination

We may terminate or suspend your access to the website immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the website will immediately cease.

19. Survival

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
